Terms of Service

These Terms of Service ("Terms") govern your use of the PassPulse website at passpulse.org and related services (the "Service"), operated by PassPulse ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

PassPulse is an AI-powered NCLEX-RN® exam preparation platform. The Service provides adaptive study plans, practice questions, readiness scoring, AI tutoring, flashcards, and performance analytics.

Important: PassPulse is an educational preparation tool only. It is not medical advice, nursing instruction, or a substitute for accredited nursing education. We do not guarantee that using PassPulse will result in passing the NCLEX-RN® or any other examination. Exam outcomes depend on many factors beyond our control.

2. Eligibility

You must be at least 16 years old to use the Service. By using PassPulse, you represent that you meet this requirement and that all registration information you provide is truthful and accurate.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • Accounts are for individual use only and may not be shared
  • You agree to provide accurate, current information and keep it updated

4. Subscription & Billing

PassPulse offers free and paid subscription plans. Paid subscriptions are billed through Stripe on a recurring monthly basis.

  • Free Trial: New users receive a 7-day free trial with access to the diagnostic and limited sessions. No credit card required to start.
  • Recurring Billing: Paid plans renew automatically each billing cycle. You will be charged the applicable rate unless you cancel before the renewal date.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
  • Price Changes: We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
  • Refunds: Refund requests are handled on a case-by-case basis. Contact support@passpulse.org within 7 days of a charge for consideration.

5. Acceptable Use

You agree not to:

  • Share, redistribute, or sell PassPulse content, questions, or materials
  • Use automated tools to scrape, copy, or extract content from the Service
  • Attempt to reverse-engineer our algorithms, scoring models, or AI systems
  • Share your account credentials or allow others to access your account
  • Use the Service for any unlawful purpose
  • Submit false, misleading, or harmful content
  • Interfere with or disrupt the Service or its infrastructure

6. Intellectual Property

All content, features, functionality, questions, algorithms, scoring models, branding, and design elements of PassPulse are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes.

NCLEX-RN® is a registered trademark of the National Council of State Boards of Nursing, Inc. (NCSBN®). PassPulse is not affiliated with, endorsed by, or sponsored by NCSBN.

7. AI-Generated Content

Portions of the Service use artificial intelligence (including models from OpenAI and Anthropic) to generate explanations, hints, and study recommendations. While we strive for accuracy, AI-generated content may occasionally contain errors. You should verify critical clinical information with authoritative nursing references.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.
  • We do not guarantee that use of PassPulse will result in passing the NCLEX-RN® or any other examination. Readiness scores and projections are estimates based on statistical models and should not be relied upon as definitive predictions.
  • In no event shall PassPulse, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill.
  • Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless PassPulse and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination:

  • Your right to access the Service ceases immediately
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination will survive (including limitations of liability, indemnification, and governing law)

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

11. Dispute Resolution

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us. If informal resolution fails after 30 days, either party may pursue binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in Los Angeles, California.

Class Action Waiver: You agree that any disputes will be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Los Angeles County, California.

13. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Miscellaneous

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PassPulse regarding the Service.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
